1. Acceptance of terms

By accessing or using MandrakeCRM ("the Service"), operated by DIO Digital E-Commerce Services LLC ("the Company"), you accept these Terms of Service. If you do not agree, you should not use the Service.

2. Description of service

MandrakeCRM is a CRM and marketing platform for e-commerce, integrated with WooCommerce. The Service includes customer management, marketing automations, email campaigns, and analytics.

3. Registration and account

To use the Service, you must:

  • Be at least 18 years old
  • Provide truthful and up-to-date information
  • Maintain one account per store
  • Be responsible for the security of your account

4. Plans and payments

The Service offers a 7-day free trial without requiring a credit card. After the trial period, you can choose between the Grow and Scale plans.

Billing is monthly and based on the number of orders received. Prices may vary by region and are subject to change with 30 days' prior notice.

5. Acceptable use

By using the Service, you agree to:

  • Not send spam or unsolicited emails
  • Not distribute illegal, defamatory, or offensive content
  • Comply with applicable data protection laws (LGPD, GDPR, CAN-SPAM)
  • Not attempt to access systems or data of other users
  • Not use the Service for fraudulent activities

6. Intellectual property

MandrakeCRM retains all intellectual property rights over the software, design, brand, and content of the Service.

The user retains all rights over their data, content, and customer information. The Company does not claim ownership of user data.

7. Service availability

We strive to keep the Service available continuously. However, we do not guarantee a specific uptime percentage. Interruptions may occur due to maintenance, updates, or circumstances beyond our control.

8. Limitation of liability

To the maximum extent permitted by law, the Company's total liability for any claim related to the Service is limited to the amount paid by the user in the last billing month.

The Company shall not be liable for indirect, incidental, special, or consequential damages.

9. Cancellation

You may cancel your account at any time. Upon cancellation:

  • Without an active plan: data is deleted immediately
  • With an active plan: the service continues until the end of the paid billing period, and data is deleted at the end of that period

10. Modifications to terms

We reserve the right to modify these Terms of Service. We will notify you of any material changes at least 30 days in advance via email or notice within the Service.

Continued use of the Service after notification constitutes acceptance of the modified terms.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes shall be resolved in the competent courts of Wyoming.
